Marijuana to be Reclassified from a Schedule 1 to Schedule 3 Substance

Written by Robb Auspitz

President Trump’s Executive Order to Re-Classify Marijuana from a Schedule 1 to a Schedule 3 Substance.
Let’s Learn More About This Executive Order.

Marijuana has been classified as a Schedule 1 substance under the Controlled Substances Act (CSA) since 1970. Since 1970, there have been several attempts to reschedule Marijuana, but it appears that this latest effort will be the first successful attempt.

Now that Medical Marijuana has essentially been rescheduled, there is expected to be a renewed push to pass the Safer Banking Act.

The Secure And Fair Enforcement Regulation Banking Act (SAFER Banking Act) was introduced to provide financial institutions that serve state-legal cannabis businesses with a legal “safe harbor.”

In the same Executive order, President Trump also urges Congress to examine updating the definition of hemp to ensure that Full-spectrum CBD is accessible to patients.

This follows a controversial piece of legislation inserted into the November 2025 bill ending the government shutdown, banning almost all CBD products.

Let’s take a deeper look at the reclassification of Marijuana and CBD, getting blindsided by Congress, including when both happened and the current state of both issues.

Trump Signs November Spending Bill That Ends the Government Shutdown, But Will Recriminalize Hemp Products with THC.

As reported in the November 5, 2025, issue of Marijuana Moment,

“Trump Signs Bill To Recriminalize Hemp THC Products, Years After Approving Their Legalization.”

Reported and written by Kyle Jaeger.

Mr.Jaeger reports that;

“President Donald Trump has signed a spending bill that includes provisions to ban most consumable hemp products.

“Following a historic, weeks-long government shutdown, the Senate approved the appropriations package on Monday to fund critical agencies. The House of Representatives followed suit on Wednesday, voting 222-209 to pass the bill.”

“Tucked inside the legislation is a controversial section to recriminalize hemp products containing THC that have proliferated since the crop was legalized under the 2018 Farm Bill that Trump signed during his first term in office. The president’s latest action reverses that move.”

Trump Signs an Executive Order Reclassifying Medical Marijuana By Transferring It From Schedule I to Schedule III of the Controlled Substances Act, Part 1.

As reported in the December 18, 2025, issue of Marijuana Moment,

“Marijuana will be federally rescheduled under an executive order signed by President Donald Trump on Thursday December 18 2025.“

“Months after Trump said a decision on the cannabis reform proposal was imminent, the president issued the directive for agencies to begin moving forward with the plan to transfer cannabis from Schedule I to Schedule III of the Controlled Substances Act (CSA).

The directive also aims to address federal hemp laws to promote access to full-spectrum CBD that could be covered under federal health insurance plans.

The president emphasized that his order “doesn’t legalize marijuana in any way, shape or form, and in no way sanctions its use as a recreational drug.”

This marks one of the most significant developments in federal marijuana policy since its prohibition a half a century ago, with a Schedule III reclassification recognizing that marijuana has medical value and a lower abuse potential compared to other Schedule I drugs like heroin.”

Trump Signs an Executive Order Reclassifying Medical Marijuana By Transferring It From Schedule I to Schedule III of the Controlled Substances Act, Part 2.

As reported in the December 18, 2025, issue of Marijuana Moment,

“The directive also aims to address federal hemp laws to promote access to full-spectrum CBD that could be covered under federal health insurance plans.”

Mr.Jaeger reports that;

“In addition to directing the attorney general to “take all necessary steps to complete the rulemaking process related to rescheduling marijuana to Schedule III of the CSA in the most expeditious manner in accordance with Federal law,”

Trump’s executive order also urges Congress to examine updating the definition of hemp to ensure that full-spectrum CBD is accessible to patients. If lawmakers do so, it could mitigate some concerns in the sector about a recent spending bill the president signed with provisions that would broadly ban consumable hemp products.”

A further redefinition of hemp would be part of a novel proposal to allow Medicare recipients to access non-intoxicating CBD that’d be covered under the federal health care plan.”

Trump Signs an Executive Order Reclassifying Medical Marijuana By Transferring It From Schedule I to Schedule III of the Controlled Substances Act, Part 3.

On April 23, 2026, Medical Marijuana, under certain conditions, was reclassified as Schedule 3. Recreational Marijuana is still classified as Schedule 1.

Read these excerpts from an article for a deeper understanding of the rescheduling of Medical Marijuana.

As reported in the April 23, 2026, issue of Marijuana Moment. Reported and written by Tom Angell.

Federal Marijuana Rescheduling Announced By Department Of Justice, Months After Trump Executive Order.

“Acting Attorney General Todd Blanche on Thursday announced that rescheduling is finally happening. The process will happen in phases, DOJ said.

Under an order signed by Blanche, marijuana products regulated by a state medical cannabis license will immediately move to Schedule III, as will any marijuana products that are approved by the Food and Drug Administration (FDA).

Then, beginning on June 29, there will be a new expedited administrative hearing process to consider the broader rescheduling of cannabis from Schedule I to Schedule III. The Federal Register filing on the hearing says it “will conclude not later than July 15.”

Marijuana to be ReClassified from a Schedule 1 to Schedule 3 Substance, Some Science, Part 1

This is an exciting and promising development, but it raises questions and concerns. Here are excerpts from a December 23, 2025, post written by Lindsey Leake and published on the NBC News Website.

“Cannabis reclassification could ‘open the floodgates’ for research, scientists say. “

Various scientists believe that reclassifying Marijuana (AKA “Cannabis”) could lead to dramatic increases in research opportunities.

“A long-awaited change in drug policy could bring scientists one step closer to understanding the harms and benefits of marijuana, the most commonly used federally illegal substance.”

“Decades of federal drug control policy have neglected marijuana’s medical uses,” the order says. “That oversight has limited the ability of scientists and manufacturers to complete the necessary research on safety and efficacy to inform doctors and patients.”

Ms. Leake continues;

“While the reclassification is intended to bolster medical marijuana research and won’t legalize cannabis at the federal level, the move comes at a time when use in the United States is at a high.”

Marijuana to be ReClassified from a Schedule 1 to Schedule 3 Substance, Some Science, Part 2

Gallup data from 2023 and 2024 estimates that 15% of adults smoke Marijuana, up from 7% in 2013.

Medical Marijuana is typically prescribed to ease chronic pain; control nausea and vomiting, often in people receiving chemotherapy for cancer; and bring about an appetite in people with certain medical conditions.

Scientists like Ziva Cooper are hopeful the reclassification could revolutionize public health through more comprehensive Marijuana research.

“It is extremely difficult to study cannabis, aka marijuana, for both the potential adverse effects as well as therapeutic effects,” said Cooper, director of the Center for Cannabis and Cannabinoids at the University of California, Los Angeles. “The industry is developing at a very fast pace, and so consumer behavior is developing along with that industry.

“It’s very hard for us, as scientists, as people who are interested in public health, to be able to keep up with the changes, in part because the research is difficult.”

Despite working in a cannabis-friendly state, Cooper said she faces the same research hurdles as her peers in states such as Idaho, where no Marijuana use is permitted whatsoever.

“Last year, the National Institutes of Health awarded $75 million to therapeutic cannabinoid research, up from $70 million in 2023. Additionally, $217 million went to cannabinoids, or cannabis compounds, and $53 million went to cannabidiol, or CBD, a nonpsychoactive cannabinoid.”

“Medical marijuana is typically prescribed to ease chronic pain; control nausea and vomiting, often in people receiving chemotherapy for cancer; and bring about an appetite in people with certain medical conditions. It’s unclear whether rescheduling cannabis will affect funding for recreational marijuana research.

However, administrative red tape means cannabis studies are often observational, compared with the rigorous clinical trials required of pharmaceutical research, said Dr. Brooke Worster, medical director of the M.S. in medical cannabis science and business program at Thomas Jefferson University in Philadelphia. Their findings have been mixed.”

“Research published this year in the journal Biomedicines suggested cannabinoids are a “promising” alternative to opioids for chronic pain management but cited an urgent need for large-scale, randomized controlled trials.”

Groovy Hemp Company Marijuana to be ReClassified from a Schedule 1 to Schedule 3 Substance FAQs

CBD stands for Cannabidiol, one of many phytocannabinoids found in cannabis. Unlike THC, CBD is not psychoactive. Additionally, independent research and consumer feedback demonstrate numerous benefits for human and pet health. In hemp, CBD Oil is found in a much higher concentration than any other cannabinoid.

CBD Oil works synergistically with your body’s Endocannabinoid System (ECS) to supplement the naturally occurring cannabinoids in your system.

When your body absorbs CBD Oil, it improves the endocannabinoid system’s ability to promote a balanced internal environment (Homeostasis).

Consuming CBD Oil products can help you maintain a regular level of CBD Oil in your system, promoting optimal wellness.

  • Beyond the physical difference, Hemp and Marijuana are strains of the Genus: Cannabis, Species: Sativa L plant with slightly different biochemical characteristics.
  • In a broad sense, Hemp and Marijuana can both have a positive impact on your health, physical and mental. However, each has a broad range of varying benefits. Too broad to be covered here.
  • Hemp was de-scheduled by the DEA in September 2018, and as of today, is 100% legal.
  • THC is the psychoactive ingredient in Marijuana that gets you high. CBD Oil products have no more than 0.3% naturally occurring THC by dry weight, which is not even remotely enough to get you high. Cannabis sold today frequently has at least 15% THC, and that will definitely get you high.
  • There are also Intoxicating Hemp products that have been chemically engineered to have higher percentages of Delta 8 and Delta 10 THC. These products can get you high to varying degrees.
  • Many states are either considering regulating or have legislated regulations controlling or banning Intoxicating Hemp products.
  • Marijuana has now attained varying forms of legality in different states and municipalities, but is still considered illegal by the Federal government in some states. Legislation has been introduced in Congress, and many states are legalizing Marijuana.
  • As of December, 2025, the president issued a directive for agencies to begin moving forward with the plan to transfer Marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA).
  • Groovy Hemp Company only provides hemp-based products with 0.3% THC or less. None of them will get you high.

The DEA, AKA the Drug Enforcement Administration, is an agency that is part of the Federal government’s Department of Justice. The DEA’s job is to enforce the laws and regulations on controlled substances in the United States.

Part of the DEA’s job is to classify various controlled substances in various Schedules. There are 5 Schedules. The controlled substances with a higher probability of abuse (among other factors) are classified as Schedule 1. The rest of the controlled substance hierarchy is defined by a succeeding reduced level of probability of abuse, etc.

E.G., Heroin is a Schedule 1 drug. Cocaine and Opioids are Schedule 2 drugs. Currently, Marijuana is inexplicably still classified as a Schedule 1 drug.

The Biden administration recommended that the DEA reschedule Marijuana from Schedule 1 to Schedule 3 in May 2024. As of December 2025, President Trump issued an Executive Order ReClassifying Marijuana from Schedule 1 to Schedule 3. As you can imagine, this has made a substantial number of people happy.

  • Full-spectrum is the only category of CBD Oil product that includes THC. If you have Drug Testing (AKA Drug Screening) at your place of employment, your best strategy is to only use Broad-spectrum and/or CBD Isolate. Both of them are THC-free.
  • Delta 9 THC is the psychoactive ingredient in Marijuana that gets you high. Marijuana typically has 15% – 25% Delta 9 THC.
  • CBD Oil products, including CBD Wellness products, are made from Hemp Oil Extract and have no more than 0.3% naturally occurring THC. That is not even remotely enough to get you high.
  • There are also Hemp-based products that have been chemically engineered to have higher percentages of Delta 8 and Delta 9 THC. These products are classified as Intoxicating Hemp.
  • groovyhempcompany.com only provides CBD Oil Wellness products. We do NOT provide intoxicating hemp products of any type. More specifically, we do NOT provide Delta 8 or Delta 9 THC products derived from Hemp or any related products.
