The Differences Between CBD, Intoxicating Hemp, and Marijuana

Written by Robb Auspitz

Confused about the Differences between CBD, Intoxicating Hemp, and Marijuana? Relax, we have you covered.

Nothing is ever as easy as it looks. When I began in the CBD business, the Genus: Cannabis, Species: Sativa L space mainstream products included Hemp-based CBD Oil products and Marijuana; that was it.

Back then, the differences between CBD and Marijuana were pretty clear. CBD Oil products were focused on creating or being part of wellness solutions.

Even though Marijuana certainly has healthy benefits, its main focus is recreational. It gets you high.

In 2018, some enterprising Hemp chemists in Colorado took advantage of a perceived loophole in the 2018 Farm Bill and developed alternate versions of Delta 9 THC (AKA Isomers) from Cannabidiol (CBD).

Delta 8 and Delta 10 THC-based products also have some health benefits, but much like Marijuana, their focus is on getting you high at one level or another.

Suddenly, the highly regulated legal Marijuana industry had completely unregulated competition. There was no way this was going to end peacefully.

Let’s take a closer look at the Differences between CBD, Intoxicating Hemp, and Marijuana, and their impact on the Marijuana and Hemp industries and society in general.

The Differences Between CBD, Intoxicating Hemp, and Marijuana: Some Background Information, Part 1

Hemp and Marijuana had been illegal until September 2018, when Congress passed the latest Farm Bill, completely removing Hemp from the DEA Schedules, effectively legalizing Hemp.

Almost immediately, two branches of Hemp products appeared in the marketplace: CBD Oil Products and Intoxicating Hemp Products.

Because the 2018 Farm Bill was written the way it was, both started 100% legal, and until recently, were completely unregulated. That is now in the process of changing.

Marijuana is legal at varying levels in different states, either medicinal or recreational, or both. In states where Marijuana is legal, it’s highly regulated.

However, in December 2025, the Trump administration issued an Executive Order to Re-Classify Marijuana from a Schedule 1 to a Schedule 3 Substance. Many scientists believe that the Marijuana (AKA Cannabis) reclassification could ‘open the floodgates’ for research.

This is a major positive, as many benefits can come from researching a substance that has been misrepresented and even demonized in our culture for well over 100 years. As of May 2026, Marijuana is still illegal at the Federal level.

The Differences Between CBD, Intoxicating Hemp, and Marijuana: Some Background Information, Part 2

On April 23, 2026, Medical Marijuana, under certain conditions, was reclassified as Schedule 3. Recreational Marijuana is still classified as Schedule 1.

Read these excerpts from an article for a deeper understanding of the rescheduling of Medical Marijuana.

As reported in the April 23, 2026, issue of Marijuana Moment. Reported and written by Tom Angell.

Federal Marijuana Rescheduling Announced By Department Of Justice, Months After Trump Executive Order.

“Acting Attorney General Todd Blanche on Thursday announced that rescheduling is finally happening. The process will happen in phases, DOJ said.

Under an order signed by Blanche, marijuana products regulated by a state medical cannabis license will immediately move to Schedule III, as will any marijuana products that are approved by the Food and Drug Administration (FDA).

Then, beginning on June 29, there will be a new expedited administrative hearing process to consider the broader rescheduling of cannabis from Schedule I to Schedule III. The Federal Register filing on the hearing says it “will conclude not later than July 15.”

The Differences Between CBD, Intoxicating Hemp, and Marijuana: CBD Wellness Products

CBD Wellness Products are a combination of phytocannabinoids and terpenes, or phytocannabinoids, terpenes, and herbal supplements formulated to ease a specific issue, condition, or symptom.

These CBD Oil Products are part of hemp-based Wellness products’ ongoing development and evolution. They can be a very powerful part of various Wellness Solutions.

Plant scientists are constantly engaged in researching and learning more about Phytocannabinoid capabilities. This is especially true when they integrate various combinations of terpenes and other healthful substances.

Terpenes are an underappreciated part of the equation. Unfortunately, most consumers looking for Wellness Solutions do not quite understand terpenes’ therapeutic impact on individual health and overall well-being. Various terpenes can help influence your emotional well-being, sleep management, and physical discomfort management, among others.

Even though both are Hemp-based, there are major differences between CBD and Intoxicating Hemp. CBD Wellness products will not get you high. Their purpose is to help you maintain or improve your overall health and well-being.

The Differences Between CBD, Intoxicating Hemp, and Marijuana: Intoxicating Hemp, What a Long Strange Trip This Has Been

This is a fascinating and controversial topic. Here are excerpts from an October 3, 2025, post written by Olivia Swann, reviewed by June Chin, DO, and posted on the Leafwell website.

“Intoxicating hemp refers to products derived from hemp plants that produce psychoactive effects.

While hemp can legally only contain up to 0.3% delta-9 THC by dry weight, intoxicating hemp often contains semi-synthetic cannabinoids at concentrations that produce a “high” or altered state of consciousness.

These include:

These compounds are typically synthesized or concentrated from naturally occurring hemp cannabinoids, such as cannabidiol (CBD), and offer varying degrees of intoxication.

Because they are technically derived from legal hemp, these semi-synthetic cannabinoids currently occupy a legal gray area in many states, leading to an increase in availability but inconsistent regulation.

Intoxicating hemp products come in a variety of forms, offering different methods of consumption and effects. You can find them online, in smoke shops and convenience stores, and increasingly in wellness and lifestyle retail settings.

Intoxicating hemp vs. cannabis.

If you’re seeking therapeutic relief, regulated cannabis products may be a better option, especially under the guidance of a medical professional. Getting a medical cannabis card not only provides access to more thoroughly tested and predictable products but also legal protection and a wider range of formulations designed for medical use.”

Intoxicating Hemp can relax you and give you a nice, mellow high. However, you need to be careful about what products you buy and where you buy them. Avoid buying from a gas station or a convenience store. They have no idea where the products come from or who manufactured them. Only buy from a reputable brand that provides a list of ingredients and a COA. These products are not regulated yet, so you need to be extra careful.

The Differences Between CBD, Intoxicating Hemp, and Marijuana: Marijuana (AKA Cannabis, Weed, or the “Evil Weed”) Part 1

The common assumption is that Marijuana only gets you high, but that is not accurate. Various studies indicate that Medical Marijuana may help with some conditions.

The conditions Medical Marijuana is allowed to treat vary by state. If you’re thinking of using medical marijuana, check your state’s laws. Whether you can get medical marijuana to treat a condition depends on the state. Conditions some states cover include:

Alzheimer’s disease, Amyotrophic lateral sclerosis (ALS), HIV/AIDS, Crohn’s disease, Epilepsy and seizures, Glaucoma, Multiple sclerosis and muscle spasms, Post-traumatic stress disorder (PTSD), Serious and ongoing pain, Serious nausea or vomiting caused by cancer treatment, and others.

Remember, not every state will cover all conditions. Contact the agency in your state responsible for managing Marijuana to find out which medical conditions are covered.

States where medical and/or recreational marijuana are legal generally sell Marijuana products through highly regulated licensed retail outlets that are frequently referred to as dispensaries.

The Differences Between CBD, Intoxicating Hemp, and Marijuana: Marijuana (AKA Cannabis, Weed, or the “Evil Weed”) Part 2

In almost every Medical or Recreational Marijuana dispensary, be prepared to either pay for your purchase in cash or via an ACH payment. Forget credit or debit cards.

Congress adamantly and stupidly refuses to pass the SAFER Banking Act, which would allow legitimate Marijuana companies to open up normal business banking accounts.

It would also qualify a dispensary for normal merchant banking accounts (required for e-commerce) and take credit or debit cards with a normal processing fee rate (e.g., 2.99%).

And one other thing, there is a “sin” tax or taxes on every Recreational Marijuana product purchase. It’s impossible to give you a coherent range of taxes because of how different states tax the “Evil Weed”.

Instead, tap or click to go to a page on the Tax Foundation’s website to see how each state imposes taxes on recreational marijuana.

Well before the infamous movie, Reefer Madness, Marijuana has been political, one way or the other.

As mentioned earlier in this article, Marijuana is being reclassified from Schedule 1 to Schedule 3, but given the current political climate, I would not count on legalization anytime before 2029.

Much like the Reefer Madness era, we currently have a group of self-righteous politicians and “community leaders” screaming about the evils of Marijuana.

That includes the DEA, and I’ll bet that surprises you endlessly.

Some states have legalized Marijuana and are enjoying the benefits of the additional tax revenue. Incredibly, they are experiencing those same self-righteous politicians attempting to roll back legalization.

Those of us who are pro-legalization need to stay awake, aware, and ready to communicate with our state and federal legislators to keep pushing them in the right direction.

The Differences Between CBD, Intoxicating Hemp, and Marijuana: Some Science.

In 2018, when the current Farm Bill was written and passed by Congress, no one ever dreamed it would result in the creation of Intoxicating Hemp, but it’s 2026, and here we are.

Here are excerpts from a post titled “What Is Intoxicating Hemp and How Is It Made?” published on biologyinsights.com. December 12, 2025. No author is listed.

We will focus on the actual manufacturing process and the legal justification.

“How Intoxicating Compounds Are Created

The cannabis plant naturally produces Delta-8 and Delta-10 THC in only trace amounts, making direct extraction impractical for commercial production.

The vast majority of intoxicating hemp products are manufactured through a chemical conversion process called isomerization. This process starts with Cannabidiol (CBD), a non-intoxicating cannabinoid highly abundant in legally grown hemp.

CBD isolate is dissolved in an organic solvent before a strong acid catalyst is introduced. The acid triggers a chemical reaction that rearranges the atoms of the CBD molecule.

This cyclization reaction converts the CBD into various forms of THC, predominantly Delta-8 THC and Delta-10 THC. Heat is often applied to accelerate this conversion process.

The resulting crude oil must then be neutralized and purified to remove residual acids, solvents, and unwanted reaction byproducts. This chemical synthesis is why these compounds are often referred to as “semi-synthetic” cannabinoids.

The process allows manufacturers to convert inexpensive, legal CBD into high-value, intoxicating THC isomers at a commercial scale. This chemical synthesis is why these compounds are often referred to as “semi-synthetic” cannabinoids.

Intoxicating Hemp‘s future in the marketplace is no doubt going to change. As of May 2026, it’s in the process of being regulated by many states and, in some states, banned.

Its long-term status is in question, and as of right now, no one really knows how this is going to end.

Groovy Hemp Company and The Differences Between CBD, Intoxicating Hemp, and Marijuana FAQs

CBD stands for Cannabidiol, one of many phytocannabinoids found in cannabis. Unlike THC, CBD is not psychoactive. Additionally, independent research and consumer feedback demonstrate numerous benefits for human and pet health. In hemp, CBD Oil is found in a much higher concentration than any other cannabinoid.

CBD Oil works synergistically with your body’s Endocannabinoid System (ECS) to supplement the naturally occurring cannabinoids in your system. When your body absorbs CBD Oil, it improves the endocannabinoid system’s ability to promote a balanced internal environment (Homeostasis). Consuming CBD Oil products can help you maintain a regular level of CBD Oil in your system, promoting optimal wellness.

  • Beyond the physical differences, Hemp and Marijuana are strains of the genus Cannabis, species Sativa L., with slightly different biochemical characteristics.
  • In a broad sense, Hemp and Marijuana can both have a positive impact on your health, physical and mental. However, each has a broad range of varying benefits. Too broad to be covered here.
  • Hemp was descheduled by the DEA in September 2018 and, as of today, is 100% legal.
  • THC is the psychoactive ingredient in Marijuana that gets you high. CBD Oil products have no more than 0.3% naturally occurring THC by dry weight, which is not even remotely enough to get you high. Cannabis sold today frequently has at least 15% THC, and that will definitely get you high.
  • There are also Intoxicating Hemp products that have been chemically engineered to have higher percentages of Delta 8 and Delta 10 THC. These products can get you high to varying degrees.
  • Many states are either considering regulations or have legislated regulations controlling or banning Intoxicating Hemp products.
  • Marijuana has now attained varying forms of legality in different states and municipalities, but is still considered illegal by the Federal government in some states. Legislation has been introduced in Congress, and many states are legalizing Marijuana.
  • As of December, 2025, the president issued a directive for agencies to begin moving forward with the plan to transfer Marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA).
  • Groovy Hemp Company only provides hemp-based products with 0.3% THC or less. None of them will get you high.

The DEA, AKA the Drug Enforcement Administration, is an agency that is part of the Federal government’s Department of Justice. The DEA’s job is to enforce the laws and regulations on controlled substances in the United States.

Part of the DEA’s job is to classify various controlled substances in various Schedules. There are 5 Schedules. The controlled substances with a higher probability of abuse (among other factors) are classified as Schedule 1. The rest of the controlled substance hierarchy is defined by a succeeding reduced level of probability of abuse, etc.

E.G., Heroin is a Schedule 1 drug. Cocaine and Opioids are Schedule 2 drugs. Currently, Marijuana is inexplicably still classified as a Schedule 1 drug.

The Biden administration recommended that the DEA reschedule Marijuana from Schedule 1 to Schedule 3 in May 2024. As of December 2025, President Trump issued an Executive Order ReClassifying Marijuana from Schedule 1 to Schedule 3. As you can imagine, this has made a substantial number of people happy.

  • Full-spectrum is the only category of CBD Oil product that includes THC. If you have Drug Testing (AKA Drug Screening) at your place of employment, your best strategy is to only use Broad-spectrum and/or CBD Isolate. Both of them are THC-free.
  • Delta 9 THC is the psychoactive ingredient in Marijuana that gets you high. Marijuana typically has 15% – 25% Delta 9 THC.
  • CBD Oil products, including CBD Wellness products, are made from Hemp Oil Extract and have no more than 0.3% naturally occurring THC. That is not even remotely enough to get you high.
  • There are also Hemp-based products that have been chemically engineered to have higher percentages of Delta 8 and Delta 9 THC. These products are classified as Intoxicating Hemp.
  • groovyhempcompany.com only provides CBD Oil Wellness products. We do NOT provide intoxicating hemp products of any type. More specifically, we do NOT provide Delta 8 or Delta 9 THC products derived from Hemp or any related products.

The abbreviation for a Certificate of Analysis is COA (AKA Independent Lab Results). You can find a COA on the individual product page under the tab marked Independent Lab Results.

  • In California, Idaho, Alabama, and Tennessee, it is currently illegal for an e-commerce store to sell and ship ANY hemp-based product that is formulated with THC of any type.
  • That includes Full-spectrum CBD Oil products (less than 0.3% delta-9 THC but more than zero % THC).
  • That means Groovy Hemp Company is NOT allowed to sell or ship Full-spectrum CBD Oil products to California, Idaho, Kansas, and Tennessee.
  • We are allowed to sell and ship THC-free CBD Oil products to those four states.
  • THC-free means 0.0% or N/D on the COA for delta-8 or delta-9 THC.
