7 Important Facts About CBD and Intoxicating Hemp

  • Fact #1: Despite appearances, the Consumable Hemp industry does not always appear to be one coherent entity. Is it possible that it’s two industries, each with a different mission and goals?

You could make a case that the Hemp industry is actually two separate industries: CBD Wellness products and Intoxicating Hemp.

CBD Wellness products focus on improving health and well-being.  You cannot get high from them. Intoxicating Hemp focuses on getting you into altered states of varying types and degrees. A pleasant by-product is that they can help you relax and de-stress, which is always good.

Currently, most CBD Wellness products are considered legal. The only exception might be Full-spectrum CBD, and that depends on the state. Intoxicating Hemp has varying degrees of legality depending on the state, or the status of a court case(s). This does not make for an especially encouraging situation.

  • Fact #2: Regulating Hemp Flower products is a highly political issue in many states, and the Federal Government, and must be discussed.

Both industries are in deep need of well-thought-out, responsible, reality-based regulation. One model to consider is Cannabis Lawyer Rod Kight’s Three Pillars:

“(1) limiting access by minors, (2) standardized quality control in production and manufacturing of cannabinoid products, and (3) uniform labeling requirements to provide sufficient information that adults can make an informed decision about the cannabinoid products they use.”

Mr. Kight’s video explains the Three Pillars in depth:” Tap or click to watch ‘Hemp: A New Vision for Cannabis Reform”

In November 2025, the US Congress created a regulatory time bomb/fiasco aimed directly at the US Hemp industry. This legislation specifies that, within one year of enactment, the weight will apply to total THC—including delta-8 and other isomers*.

Legal hemp products will be limited to a total of 0.4 milligrams per container of total THC or any other cannabinoids with similar effects*.

This piece of legislative brilliance effectively cripples the American Hemp industry as it deems as much as 95% of all consumable Hemp products illegal.

Another consequence of that poorly thought-out legislation is that several states are mimicking the formulation restrictions. This was/ is not a great idea.

No matter what certain politicians might think, Intoxicating Hemp is not going away. All this approach does is drive Intoxicating Hemp products underground. They will be completely unsupervised and unregulated, and potentially more dangerous to users than current versions.

This has the potential of becoming a very bizarre and possibly more destructive 21st-century version of the Paraquat herbicide fiasco/disaster of the 1970s and 1980s. In all cases, well-thought-out, responsible, reality-based regulation is an infinitely better solution and is attainable.

  • Fact #3: CBD stands for Cannabidiol, one of the more important phytocannabinoids found in cannabis. Let’s talk about what it is, what it does, and how it works.

Unlike THC, CBD is not psychoactive. Additionally, independent research and consumer feedback demonstrate numerous benefits for human and pet health. In hemp, CBD Oil is found in a much higher concentration than any other cannabinoid.

Ingested CBD Oil may help you relax and de-stress, it could reduce inflammation and physical discomfort, and sometimes proves to be a very effective treatment for anxiety, among other benefits.

Topically applied CBD Oil could reduce inflammation and possibly relieve muscular and joint physical discomfort. Depending on the purpose and formulation, Topically applied CBD Oil may also rejuvenate, hydrate, and moisturize, and protect the skin.

CBD Oil works synergistically with your body’s Endocannabinoid System (ECS) to supplement the naturally occurring cannabinoids in your system. When your body absorbs CBD Oil, it improves the endocannabinoid system’s ability to promote a balanced internal environment (Homeostasis).

Consuming CBD Oil products can help you maintain a regular level of CBD Oil in your system, promoting optimal wellness.

  • Fact #4: CBD Wellness Products are a category of CBD Oil products.

CBD Wellness Products are a combination of phytocannabinoids and terpenes, or phytocannabinoids, terpenes, and herbal supplements formulated to ease a specific issue, condition, or symptom.

Some of the specific issues and conditions include:

  • Relaxing and De-stressing
  • Sleep Management
  • Pain Mitigation and Management
  • Restoring and maintaining Focus
  • Recovering from Inflammation, including and especially muscle and joint soreness
  • Women’s Skin Care
  • Weight Management

Frequently,  these very specific CBD Oil categories are also referred to as “Benefits.”

  • Fact #5: Intoxicating Hemp refers to products derived from hemp plants that produce psychoactive effects.

Intoxicating hemp often contains semi-synthetic cannabinoids at concentrations that produce a “high” or altered state of consciousness.

While hemp can legally only contain up to 0.3% delta-9 THC by dry weight, intoxicating hemp often contains semi-synthetic cannabinoids at concentrations that produce a “high” or altered state of consciousness.

The list of synthetic cannabinoids includes Delta 8 THC, Delta 10 THC, HHC, THCP, THC-O, and others. Various ways to use Intoxicating Hemp include tinctures, edibles, and vaping. In all cases, purchase Intoxicating Hemp from a reputable merchant that can provide ingredients and a COA.

Tap or click to learn more about reading and understanding a COA at the groovyhempcompany.com Blog Post: “Understanding a CBD Oil Product COA, AKA Independent Lab Result”.

  • Fact #6: Intoxicating Hemp and Health Benefits

Currently, we know that Intoxicating Hemp appears to be very useful for helping people relax and de-stress.

Much like CBD Oil, real resources, including time and money, need to be invested in researching this class of products to determine whether they offer any other tangible benefits.

  • Fact #7: Let’s talk about Drug Screening

If you’re in a drug testing (AKA drug-screening) situation, there is a good possibility that you will get tested for Delta 8, Delta 9, or Delta 10 THC. Marijuana typically contains a significant percentage of Delta 9 THC.

Intoxicating Hemp contains varying amounts of Delta 8 or Delta 10 THC. If you currently don’t smoke or ingest edibles with significant amounts of Marijuana, use Intoxicating Hemp, but take Full-spectrum CBD Oil products, this test could still be a problem. Why? Full-spectrum CBD includes traces of Delta 9 THC.

Does this mean you stop taking all CBD? No, just Full-spectrum CBD. Because there’s less than 0.3% of Delta 9 THC in Full-spectrum CBD, you are not going to/cannot get high from it.

If you’re being tested, that doesn’t matter. The employer generally won’t care about the amount of THC, just that it’s there.

  • Beyond the physical differences, Hemp and Marijuana are strains of the genus Cannabis, species Sativa L., with slightly different biochemical characteristics.
  • In a broad sense, Hemp and Marijuana can both have a positive impact on your health, physical and mental. However, each has a broad range of varying benefits. Too broad to be covered here.
  • Hemp was descheduled by the DEA in September 2018 and, as of today, is 100% legal.
  • THC is the psychoactive ingredient in Marijuana that gets you high. CBD Oil products have no more than 0.3% naturally occurring THC by dry weight, which is not even remotely enough to get you high. Cannabis sold today frequently has at least 15% THC, and that will definitely get you high.
  • There are also Intoxicating Hemp products that have been chemically engineered to have higher percentages of Delta 8 and Delta 10 THC. These products can get you high to varying degrees.
  • Many states are either considering regulations or have legislated regulations controlling or banning Intoxicating Hemp products.
  • Marijuana has now attained varying forms of legality in different states and municipalities, but is still considered illegal by the Federal government in some states. Legislation has been introduced in Congress, and many states are legalizing Marijuana.
  • As of December, 2025, the president issued a directive for agencies to begin moving forward with the plan to transfer Marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA).
  • Groovy Hemp Company only provides hemp-based products with 0.3% THC or less. None of them will get you high.

The DEA, AKA the Drug Enforcement Administration, is an agency that is part of the Federal government’s Department of Justice. The DEA’s job is to enforce the laws and regulations on controlled substances in the United States.

Part of the DEA’s job is to classify various controlled substances in various Schedules. There are 5 Schedules. The controlled substances with a higher probability of abuse (among other factors) are classified as Schedule 1. The rest of the controlled substance hierarchy is defined by a succeeding reduced level of probability of abuse, etc.

E.G., Heroin is a Schedule 1 drug. Cocaine and Opioids are Schedule 2 drugs. Currently, Marijuana is inexplicably still classified as a Schedule 1 drug.

The Biden administration recommended that the DEA reschedule Marijuana from Schedule 1 to Schedule 3 in May 2024. As of December 2025, President Trump issued an Executive Order ReClassifying Marijuana from Schedule 1 to Schedule 3. As you can imagine, this has made a substantial number of people happy.

  • Full-spectrum is the only category of CBD Oil product that includes THC. If you have Drug Testing (AKA Drug Screening) at your place of employment, your best strategy is to use only Broad-spectrum and/or CBD Isolate. Both of them are THC-free.
  • Delta 9 THC is the psychoactive ingredient in Marijuana that gets you high. Marijuana typically has 15% – 25% Delta 9 THC.
  • CBD Oil products, including CBD Wellness products, are made from Hemp Oil Extract and have no more than 0.3% naturally occurring THC. That is not even remotely enough to get you high.
  • There are also Hemp-based products that have been chemically engineered to have higher percentages of Delta 8 and Delta 9 THC. These products are classified as Intoxicating Hemp.
  • groovyhempcompany.com only provides CBD Oil Wellness products. We do NOT provide intoxicating hemp products of any type. More specifically, we do NOT provide Delta 8 or Delta 9 THC products derived from Hemp or any related products.

The abbreviation for a Certificate of Analysis is COA (AKA Independent Lab Results). You can find a COA on the individual product page under the tab marked Independent Lab Results.
